This Customer Service Agreement ("Agreement") governs the use of the DumpHero Platform by customers requesting services.

By using the Platform, requesting services, submitting payment information, or accepting bids, Customer agrees to be bound by this Agreement.

1. Marketplace Relationship

​

DumpHero is a technology marketplace that connects Customers with independent service providers ("Heroes").

DumpHero does not provide hauling, moving, junk removal, labor, transportation, disposal, cleanup, or related services.

All services are performed solely by independent Heroes.

​

2. Customer Responsibilities

​

Customer agrees to provide complete and accurate information regarding the requested work, including job size, location, accessibility, materials involved, and any special circumstances.

Customer is responsible for providing safe access to the work location.

​

3. Prohibited Materials

​

Customer shall not request the removal, transportation, storage, handling, or disposal of hazardous waste, toxic substances, explosives, firearms, illegal drugs, biohazards, regulated medical waste, or other prohibited materials.

Customer assumes full responsibility for any undisclosed prohibited materials.

4. Estimates and Pricing

​

Quotes submitted by Heroes are based upon information supplied by Customer.

If job conditions differ materially from what was disclosed, pricing may be adjusted accordingly.

5. Payments

​

Customer authorizes DumpHero and its payment processor to charge Customer's selected payment method for service fees, Platform fees, taxes, processing fees, cancellation fees, adjustments, and other authorized charges.

DumpHero may hold funds until services are completed and disputes are resolved.

​

6. Refunds, Cancellations, and Disputes

​

Customers may cancel jobs through the Platform.

Cancellation fees may apply if a Hero has accepted the job, begun travel, arrived at the job site, or incurred costs.

Refund requests must generally be submitted within seven (7) days following service completion.

DumpHero reserves the right to investigate refund requests and may issue refunds, credits, or deny requests based upon available evidence.

7. Property Damage and Service Claims

​

Customer acknowledges that all services are performed by independent Heroes.

Any claim involving property damage, personal injury, negligence, theft, service quality, incomplete work, delays, misconduct, or other service-related issues must be brought directly against the Hero performing the services.

DumpHero does not supervise Heroes, inspect job sites, guarantee service outcomes, or assume responsibility for damages arising from services.

Customer releases DumpHero from claims arising from services performed by Heroes to the fullest extent permitted by law.

8. Reviews and Ratings

​

Customers may submit reviews and ratings based upon actual experiences.

DumpHero reserves the right to remove reviews that are false, misleading, defamatory, abusive, fraudulent, or otherwise inconsistent with Platform policies.

9. Anti-Circumvention

​

Customer agrees not to intentionally bypass the Platform by directly engaging Heroes introduced through DumpHero for a period of twelve (12) months following initial introduction.

Customers who circumvent the Platform may be charged fees equal to the fees that would otherwise have been earned by DumpHero and may have their accounts terminated.

10. Non-Solicitation

​

Customer agrees not to directly recruit, hire, engage, or solicit DumpHero employees, contractors, consultants, or representatives without prior written authorization from DumpHero.

11. Acceptable Use

​

Customer shall not submit fraudulent requests, misrepresent job conditions, conceal prohibited materials, harass Heroes, misuse personal information, interfere with Platform operations, or violate any applicable law.

12. Communications Consent

​

Customer consents to receiving communications from DumpHero through email, telephone calls, mobile application notifications, and SMS text messaging regarding bids, scheduling, account activity, payments, customer service matters, and Platform updates.

13. Electronic Signatures

​

Customer agrees that electronic signatures, acceptance buttons, checkboxes, payment authorizations, and electronic acknowledgements constitute legally binding signatures.

14. Disclaimer of Warranties

​

The Platform is provided on an "as is" and "as available" basis.

DumpHero makes no representations or warranties regarding service quality, timeliness, availability, safety, legality, qualifications of Heroes, or outcomes of services performed.

15. Limitation of Liability

​

To the fullest extent permitted by law, DumpHero shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from use of the Platform.

Any liability of DumpHero shall be limited to the Platform fees paid by Customer in connection with the transaction giving rise to the claim.

16. Arbitration and Governing Law

​

Any dispute arising from this Agreement shall be resolved exclusively through binding arbitration in Connecticut.

This Agreement shall be governed by the laws of the State of Connecticut.
