Welcome to DumpHero ("DumpHero," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the DumpHero website, mobile application, and related services (collectively, the "Platform"). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Description of Services

​

DumpHero operates an online marketplace that connects individuals and businesses seeking junk removal, hauling, moving, cleanout, and related services ("Customers") with independent service providers ("Heroes"). DumpHero is solely a technology platform and marketplace facilitator. DumpHero does not perform hauling, moving, junk removal, disposal, transportation, labor, or cleanup services and is not a party to any agreement between Customers and Heroes. All services are provided independently by Heroes, who are not employees, agents, partners, representatives, or joint venturers of DumpHero.

2. Eligibility

​

The Platform may only be used by individuals who are at least eighteen (18) years of age and capable of entering into legally binding agreements. By using the Platform, you represent and warrant that you meet these requirements and have the authority to enter into these Terms.

3. Customer Responsibilities

​

Customers are responsible for providing accurate and complete information regarding any service request submitted through the Platform. Customers agree to disclose any conditions, access limitations, weight restrictions, hazardous circumstances, or special requirements associated with a job. Customers further agree not to request the removal, transportation, handling, storage, or disposal of any hazardous materials, toxic substances, explosives, firearms, illegal drugs, biohazardous materials, or any items prohibited by applicable law. Customers acknowledge that failure to accurately disclose job details may result in additional fees, cancellation of services, or refusal of service by a Hero.

4. Hero Responsibilities

​

Heroes are solely responsible for determining how services are performed and for complying with all applicable federal, state, and local laws. Heroes represent and warrant that they possess all licenses, permits, registrations, and qualifications required to perform the services they offer through the Platform. Heroes are solely responsible for their taxes, insurance, equipment, personnel, vehicles, and business operations. DumpHero does not supervise, direct, or control the manner in which Heroes perform services.

5. Booking, Payments, and Fund Holds

​

When a Customer accepts a Hero's bid or proposal, the Customer authorizes DumpHero and its payment processor to charge the payment method provided for the agreed-upon service amount, applicable fees, taxes, and processing charges. DumpHero reserves the right to pre-authorize, collect, hold, or temporarily restrict funds associated with a transaction until the job has been completed and any disputes have been resolved.

Customers acknowledge that payment may be held in escrow-like status until both parties confirm completion of the job or until DumpHero determines, in its sole discretion, that the job has been substantially completed. DumpHero reserves the right to delay, withhold, reverse, or adjust payments when fraud, chargebacks, disputes, safety concerns, policy violations, or other issues are suspected.

All Customer payments are processed securely through Stripe, DumpHero's third-party payment processor. DumpHero does not collect, store, or have access to Customer payment card details. All payment information is transmitted directly to and stored by Stripe in accordance with Stripe's terms of service and privacy policy.

6. Hero Payouts and Identity Verification

​

Before receiving any payout through the Platform, Heroes must complete identity verification ("KYC") as required by Stripe, DumpHero's payment processor. This may include providing government-issued identification, tax identification information, and banking details. All payout and banking information provided by Heroes is collected and stored directly by Stripe; DumpHero does not access or store Hero payment details.

Once a payout becomes available, Heroes may either (a) withdraw funds instantly, subject to an instant payout fee, or (b) receive funds via standard payout to the payment method on file with Stripe, which will typically be delivered within seven (7) days. Payout timing is subject to Stripe's processing schedules and any holds described in Section 5.

7. Cancellations and No-Shows

​

Customers may cancel service requests subject to applicable cancellation fees. If a Customer cancels after a Hero has accepted a job, traveled to the location, or incurred expenses, DumpHero may assess reasonable cancellation charges. If a Customer is unavailable, denies access, materially misrepresents the scope of work, or otherwise prevents completion of the service, the Customer may be charged up to the full quoted amount.

Heroes who repeatedly cancel accepted jobs, fail to appear for scheduled appointments, or engage in unreliable conduct may be suspended or permanently removed from the Platform.

8. Job Completion and Dispute Resolution

​

Customers and Heroes are encouraged to confirm job completion through the Platform. If a dispute arises regarding pricing, scope of work, property condition, completion status, additional charges, or any other matter related to a transaction, DumpHero may investigate the dispute and request photographs, communications, invoices, receipts, or other supporting documentation from either party.

Users agree to cooperate fully with any investigation. DumpHero reserves the right to make a determination regarding payment release, refunds, adjustments, or other remedies based on the information available. To the fullest extent permitted by law, DumpHero's determination shall be final and binding with respect to payments processed through the Platform.

9. Marketplace Protection and Anti-Circumvention

​

The DumpHero Platform, technology, marketing, lead generation efforts, and customer relationships constitute valuable business assets. Accordingly, Customers and Heroes agree that if they are introduced, matched, connected, or otherwise become aware of one another through the Platform, they shall not intentionally circumvent DumpHero by conducting transactions outside the Platform for a period of twelve (12) months following their initial connection.

Any attempt to avoid platform fees, service fees, booking fees, or transaction processing fees by completing transactions directly outside the Platform may result in account suspension, account termination, forfeiture of funds held by DumpHero, and the assessment of damages equal to the fees that would have otherwise been earned by DumpHero. DumpHero reserves all rights and remedies available under law or equity to enforce this provision.

10. Platform Fees

​

DumpHero may charge service fees, processing fees, booking fees, marketplace fees, premium listing fees, subscription fees, advertising fees, or other charges in connection with use of the Platform. All fees will be disclosed prior to the completion of a transaction where required by law. DumpHero reserves the right to modify its fee structure at any time.

11. User Content

​

Users may submit reviews, ratings, photographs, comments, messages, and other content through the Platform. By submitting content, users grant DumpHero a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, display, publish, distribute, and create derivative works from such content for any lawful business purpose.

Users represent and warrant that they own or possess all necessary rights to any content they submit and that such content does not violate the rights of any third party.

12. Ratings and Reviews

​

DumpHero may allow Customers and Heroes to submit ratings and reviews. Users agree that reviews must be truthful, accurate, and based on actual experiences. DumpHero reserves the right, but not the obligation, to remove or modify reviews that are fraudulent, defamatory, misleading, abusive, offensive, or otherwise inconsistent with these Terms.

13. SMS/Text Messaging

By creating an account, you opt in to receive OTP and job notifications via SMS from DumpHero. Message frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to unsubscribe.

14. Prohibited Conduct

​

Users may not engage in fraudulent conduct, impersonation, harassment, threats, abuse, unauthorized commercial activity, interference with the Platform, or any activity that violates applicable law. DumpHero reserves the right to investigate suspected violations and take any action it deems appropriate, including suspension or termination of accounts.

15. Independent Contractor Relationship

​

Nothing contained in these Terms shall be construed to create an employment relationship, partnership, agency relationship, franchise relationship, or joint venture between DumpHero and any Hero. Heroes operate independent businesses and retain sole control over how services are performed.

16. Disclaimer of Warranties

​

The Platform is provided on an "as is" and "as available" basis. DumpHero makes no representations or warranties regarding the availability, reliability, quality, legality, safety, timeliness, or suitability of any services offered through the Platform. DumpHero does not guarantee that any Customer or Hero will meet the expectations of the other party.

17. Limitation of Liability

​

To the fullest extent permitted by law, DumpHero shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to the use of the Platform or any services provided by Heroes. This limitation includes, without limitation, claims relating to property damage, personal injury, service quality, delays, disposal decisions, lost profits, lost business opportunities, or disputes between users.

In no event shall DumpHero's total liability exceed the total amount of fees actually paid to DumpHero in connection with the transaction giving rise to the claim.

18. Property Damage and Service Claims

​

Customers acknowledge and agree that all hauling, moving, junk removal, cleanup, transportation, labor, disposal, and related services are performed exclusively by independent Heroes and not by DumpHero.

Any claim arising from property damage, personal injury, negligence, misconduct, service quality, incomplete work, improper disposal, delays, theft, loss of property, or any other act or omission occurring during the performance of services must be brought directly against the Hero who performed the services.

DumpHero does not assume responsibility for the conduct, actions, omissions, workmanship, safety practices, vehicle operation, disposal methods, or business practices of any Hero. DumpHero does not inspect job sites, supervise services, guarantee the qualifications of Heroes, or warrant the outcome of any service performed through the Platform.

To the fullest extent permitted by law, Customers release and hold harmless DumpHero, its officers, directors, employees, affiliates, successors, and assigns from any claims, demands, liabilities, damages, losses, costs, or expenses arising from or related to services performed by a Hero.

Customers are encouraged to inspect completed work prior to approving job completion and releasing payment. Any disputes regarding property damage, workmanship, or service quality should be documented and reported promptly through the Platform. DumpHero may, but is not obligated to, facilitate communication between the parties or assist in resolving disputes.

19. Indemnification

​

Users agree to defend, indemnify, and hold harmless DumpHero, its officers, directors, shareholders, employees, affiliates, successors, and agents from and against any claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys' fees, arising from their use of the Platform, violation of these Terms, violation of applicable law, or interactions with other users.

20. Intellectual Property

​

All trademarks, logos, service marks, software, content, designs, graphics, technology, and intellectual property associated with DumpHero remain the exclusive property of DumpHero and its licensors. Users may not reproduce, distribute, modify, or exploit any portion of the Platform without prior written consent.

21. Account Suspension, Termination, and Deletion

​

DumpHero may suspend, restrict, or terminate any account at any time, with or without notice, for violations of these Terms, suspected fraud, safety concerns, legal compliance requirements, non-payment, abuse of the Platform, or any other reason deemed appropriate by DumpHero.

Users may request deletion of their account at any time by contacting support@dumphero.com. Account deletion requests will be processed within seven (7) days of receipt. DumpHero may retain certain information as required by law, for tax and accounting purposes, to resolve disputes, to complete pending transactions, or to enforce these Terms.

22. Arbitration and Class Action Waiver

​

Any dispute arising out of or relating to these Terms or the use of the Platform shall be resolved exclusively through binding arbitration conducted in the State of Connecticut. Users waive any right to participate in a class action, class arbitration, or representative proceeding.

23. Governing Law

​

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles.

24. Modifications

​

DumpHero reserves the right to modify these Terms at any time. Continued use of the Platform following any modification constitutes acceptance of the revised Terms.
